User and Privacy Agreement

4.2. User’s Rights and Obligations
4.2.1. Pepech has no responsibility to verify the accuracy of the information provided by the User. The User is responsible for the accuracy of all information and statements entered. The User accepts, declares, and undertakes that they will bear all consequences arising from providing untrue information.
4.2.2. The User accepts and declares that they will receive service within the scope of the information specified on the Website. The User accepts, declares, and undertakes to enter the requested information completely and accurately to receive service.
4.2.3. The User accepts, declares, and undertakes to provide all information requested on the Website completely, accurately, and up-to-date.
4.2.4. By visiting and using the Website, the User accepts, declares, and undertakes to comply with the following: All kinds of information, content, and documents belonging to Pepech and/or other third parties on the Website, such as pictures, texts, files, visual and auditory images, icons, databases, titles, business names, content, software, products, designs, brands, patents, logos, and similar, are under protection. The User shall not copy, reproduce, publish, modify, translate into another language, store, or subject to any process; distribute, process, upload, display, destroy, or use in any way the aforementioned without the written permission of Pepech. The User shall not use all or part of the Website on another site without Pepech’s permission and shall not provide a link to the Website without Pepech’s written permission. Furthermore, the User agrees not to compete directly and/or indirectly with Pepech and not to use the Website for any illegal and/or unauthorized purpose.

4. Intellectual Property Rights
   

   5.1. All rights regarding the Web Site and its software; all registered or unregistered intellectual property rights such as title, trade name, brand, patent, logo, design, text, image, icon, information, and method found on the Web Site belong to Pepech and are protected by national and international law. Visiting the Web Site or utilizing its services does not grant the User any rights regarding these intellectual property rights. The User agrees not to infringe the aforementioned intellectual property rights by visiting or using the Web Site. All material and intellectual rights, assets, and know-how owned by Pepech through the Web Site are reserved.
   5.2. Any use of the information contained on the Web Site, including reproduction, translation into another language, storage, or subjection to any process, is prohibited. Information on the Web Site may not be published, copied, presented, and/or transferred in any way without Pepech’s written permission. The entire Web Site or any part of it may not be used on another website without Pepech’s permission. No links may be made to the Web Site without Pepech’s written permission.
   5.3. For users who use all registered or unregistered intellectual property rights such as design, picture, database, file, title, trade name, brand, patent, logo, text, visual and auditory image, icon, information, and method, which are subject to copyright, without explicit permission and in an unauthorized manner, their access to the Web Site and/or their rights to use the Web Site will be revoked, and in case such use is detected, all legal and administrative recourse rights are reserved.

6. Responsibilities
   

   6.1. All legal, criminal, and other liabilities for every transaction and action made by the user on the Website belong to the user. The user agrees to comply with the provisions of applicable laws and regulations when using the Website, and that otherwise, all legal and criminal liabilities that may arise shall belong solely and exclusively to them. The user agrees not to perform any action that imposes an unreasonable or disproportionately large load on the Website infrastructure, not to access the Website without authorization, and not to use the Website without authorization; and accepts and undertakes to compensate Pepech and third parties for any damages incurred due to unfair and unlawful use of the Website.
   6.2. Pepech cannot be held responsible for material, moral, legal, financial consequences or loss of profit that may arise from the incorrect or unlawful use of the content and services provided through the Website, or their use for unlawful purposes; or for damages that may be incurred by third parties. In this context, should any liability be imposed on Pepech, the users who caused this accept, declare, and undertake to immediately compensate Pepech for all its damages.

7. Force Majeure

   7.1. Situations such as cyber attack, natural disaster, rebellion, war, act of terrorism, strike, epidemic, communication problems, infrastructure and internet failures, power outage, bad weather conditions, which are beyond the reasonable control of the relevant party and unforeseeable, and which cannot be prevented or avoided despite showing due diligence, will be considered as “Force Majeure”. In cases of force majeure, Pepech is not responsible for performing any of its obligations specified in this Agreement late or incompletely, or for not performing them at all. During the period of force majeure, no compensation can be claimed from Pepech under any name.

8. Other Matters

   8.1. The user accepts that they receive an offer/service from Pepech and through the Web Site under current market conditions for the product or service they requested. Pepech has no legal relationship, partnership, or affiliation with other persons and organizations accessed through links provided on the Web Site. Pepech does not assume responsibility for the commitments or reliability of these persons and organizations; it does not mean that Pepech acts on behalf of these persons or institutions, represents them, is their business partner, or authorizes them in any matter. Therefore, Pepech cannot be held responsible for the actions and transactions of the aforementioned persons/institutions. No commitment not explicitly given by Pepech is binding for Pepech. Pepech is not responsible for information/changes in information not included on the Web Site or not duly notified to Pepech in writing, nor for viruses and similar threats arising from the use of the Web Site. Pepech is in no way responsible for damages arising directly or indirectly from any malfunction, error, omission, interruption, transmission delay, computer virus, line or system failure, or force majeure during the use of the Web Site. Pepech may cancel or change any part of the Web Site at any time, or restrict access to certain features and information on the Web Site or certain parts of the site without prior notice. Although Pepech has taken virus protection measures for the Web Site, it does not guarantee this. Users must also take protective measures against viruses for their own systems.
   8.2. The “Privacy Policy” on the Web Site is an integral part of this Agreement, and Users declare that they have read, accepted, and will comply with the provisions of the Privacy Policy; otherwise, they should not use the Web Site.
   8.3. In case of violation of the provisions of this Agreement, Pepech may prevent the User from using the Web Site and/or resort to legal remedies.
   8.4. In any dispute arising from the use of the Web Site and its services, Pepech records (books and documents, log records, electronic and computer records) shall constitute definitive and exclusive evidence.

9. Governing Law and Jurisdiction

Turkish Law shall apply to the implementation and interpretation of this Agreement. In the resolution of any disputes arising from the Agreement, Istanbul (Çağlayan) Courts and Enforcement Offices are authorized.
